The Superior Court
The State's Highest Court, handling matters of distinct importance; including criminal and certain civil proceedings. The Superior Court is headed by Chief Judge Jay Wade.
NOTICE ON EX PARTE COMMUNICATION
If you are a party to a matter before this Court, please take notice that you cannot communicate with the judge about your matter unless the other party is present. This is true for both civil and criminal matters. Violating this rule is called "ex parte communication" and will result in sanctions for the offending party. This rule applies to plaintiffs, defendants, prosecutors, and their attorneys.
Criminal docket
The Superior Court administrates the criminal docket, including all filed, open, and pending criminal matters. The Court hears probable cause motions, pre- and post-trial motions, trials, and requests for post-conviction relief. From time to time, arrest warrants may be issued by the Common Pleas Court as well as the Superior Court.
Civil Proceedings
The Superior Court hears civil matters in a limited scope. In order to be heard by the Superior Court, your case must meet at least one of the following qualifications: (1) the amount of money in controversy is over $35,000.00, (2) the civil claim being made is against a government agency, (3) the civil claim being made involves violations of civil rights statutes. If your matter does not qualify under one of the previously listed sections, your case must be decided in Common Pleas Court. After a decision in Common Pleas is rendered, you may appeal the finding to the Superior Court.
